Fees will be effective as of November 1, 2008

Please note if you do not have a mail box at the Genesee County Clerk's Office,  the Clerk  will not mail your original recorded document back to you unless you include a self addressed stamped envelope.  If you mail a closing package to Corner Stone Abstract please include self addressed stamped envelopes.

RECORDING FEE NOTES:

 

1.

Basic fee includes a cover sheet, which the county will prepare.

 

2.

If a section 255 Mortgage Tax Affidavit of Exemption is submitted with a refinancing by consolidation, extension or modification of a fixed amount mortgage and/or line of credit, add $5.00 to the recording fee.

 

3.

For multiple mortgage discharges, multiply the computed fee for the first by the number of discharges.

TRANSFER AND FINANCING FEES/TAXES:

 

Real Estate Transfer Tax

.................... $2.00 per $500 or fraction thereof of consideration

 

 

Mortgage Tax

.................... $1.25 per $100 or major fraction thereof of debt

 

 

Mortgage Tax (Federal Credit Union)

.................... $1.00 per $100 or major fraction thereof of debt

 

 

If consideration is $500 or less, no transfer tax is due. Mortgage tax rate is for 1-2 family dwellings if $10,000 or more, less a $25 credit, and 1.25 per $100 if $10,000 or less. Rate is 1.25 per $100 for other properties. Also see recording notes.

DOCUMENTATION/RECORDING NOTES:

  • Document numbering system: Liber & Page. Example: Liber 565 Deed Page 223
  • This office will provide Conformed Copies. Filer must provide copy. Include a self-addressed, stamped envelope for return of Conformed Copies.
  • Blanket assignments are accepted.
  • Blanket releases are accepted.
  • Originals of real estate documents are returned after recording.
  • A self addressed stamped return envelope of the proper size is required.
  • In subsequent related documents, include references to all prior related documents.
  • Index for Deeds: Deeds
  • Index for Mortgages: Mortgages
  • Limit blanket assignments to 20 per instrument.
  • Common document errors include incorrect fee, incomplete notarial certificate, missing or incorrect reference to previously recorded document, missing signature, corporate seal missing when required, and submitting document to the wrong county.

LEGAL DESCRIPTION: Legal description required only with deeds and mortgages (trust deeds).

PARCEL IDENTIFICATION NUMBERS: Not required.
